Terms of Use
These Terms of Use govern your access to and use of all ManageMyHealth websites, mobile websites, and mobile applications, collectively “ManageMyHealth”.
By using any ManageMyHealth website, or by downloading and / or using a ManageMyHealth mobile application, you confirm that you agree to these Terms of Use and to the ManageMyHealth Privacy Policy. If you do not agree, do not use our websites and do not download and use our mobile apps.
You are responsible for ensuring the security of the personal information held on your computer, mobile or other device.
IMPORTANT NOTICE – PLEASE READ
The content available from or on ManageMyHealth is intended to provide general information to the public and is not intended to address specific circumstances of any particular individual or entity. All reasonable measures have been taken to ensure the quality and accuracy of the information available on ManageMyHealth.
The functions and contents of ManageMyHealth should not be construed as medical, legal or professional advice and you should take specific advice from qualified professionals before undertaking any course of action or treatment on the basis of information received from ManageMyHealth. You acknowledge that ManageMyHealth is not a healthcare provider, and that ManageMyHealth will not be responsible to you for any action or inaction you take as a result of following the contents of ManageMyHealth.
ManageMyHealth is not responsible for the actions or inactions of any third party, or for your relationship with them.
Some of the functions offered by ManageMyHealth to support you on your healthcare journey rely on information provided to ManageMyHealth by you or your healthcare providers. If such information is incorrect or incomplete, these functions may not offer appropriate recommendations or support to you.
Any reference to any specific commercial product, process, or service by trade name, trademark, manufacture, or otherwise does not constitute an endorsement or recommendation by MMH.
1. About These Terms of Use
1.1 In consideration for Manage My Health Limited (“MMH”, “We” or “Us”) allowing you the right to access and use the ManageMyHealth and managemyhealth.co.nz service (“ManageMyHealth”) you agree to be bound by these Terms of Use. This right is non-exclusive and non-transferable and limited by these Terms of Use.
1.2 These Terms of Use apply to any user of ManageMyHealth whether they are a visitor, account holder, health professional or otherwise.
1.3 By using ManageMyHealth you agree to be bound by these Terms of Use, which shall take effect immediately the first time you use ManageMyHealth. If you do not agree to be bound by all of these Terms of Use please do not access, use and/or contribute to ManageMyHealth.
1.4 MMH may change these Terms of Use from time to time and accordingly you should check these Terms of Use regularly. Your continued use of ManageMyHealth will be deemed acceptance of the updated or amended Terms of Use. If you do not agree to the changes, you should cease using ManageMyHealth.
1.5 If there is any conflict between these Terms of Use and specific local terms appearing elsewhere on ManageMyHealth or terms entered into independently with MMH, then the specific or independent terms of use shall prevail.
2. Use of ManageMyHealth and Your Obligations
2.1 You agree in using ManageMyHealth that you will:
(a) comply with all laws;
(b) comply with all ManageMyHealth policies;
(c) comply with all ManageMyHealth Code of Conduct;
(d) comply with Privacy Policy;
(e) keep all access details including passwords and codes secret; and
(f) notify MMH if you learn of a security breach related to ManageMyHealth by emailing us at [email protected].
2.2 You agree in using ManageMyHealth that you will not:
(a) infringe the privacy rights of any ManageMyHealth user;
(b) use ManageMyHealth in a way that harms ManageMyHealth or our related entities, partners, resellers, distributors, suppliers and/or vendors (each referred to as a “ManageMyHealth Party”), or any customer of a ManageMyHealth Party;
(c) mislead any ManageMyHealth user, including supplying data that is falsely made to appear as originating from or being endorsed by ManageMyHealth;
(d) use any portion of ManageMyHealth as a destination linked from any unsolicited bulk messages or unsolicited commercial messages;
(e) use any unauthorised means to modify or reroute, or attempt to modify or reroute ManageMyHealth; damage, disable, overburden, or impair ManageMyHealth (or the network(s) connected to ManageMyHealth) or interfere with anyone’s use and enjoyment of ManageMyHealth; or
(f) resell or redistribute ManageMyHealth or any part of the ManageMyHealth services.
2.3 You may use ManageMyHealth:
(a) in connection with your registered GP practice, including to communicate with the practice and to book appointments. If you change GP practices or otherwise disengage from your GP practice, you will still remain registered with ManageMyHealth and you will still be bound by these Terms of Use. You may use ManageMyHealth in connection with any new GP practice you register with, if that practice also uses ManageMyHealth; or
(b) independently of any GP practice, in which case you will not be able to use the functionality within ManageMyHealth that relates to interactions with a GP practice, but you will be able to access other ManageMyHealth functionality and will be bound by these Terms of Use.
2.4 We do not recommend sharing your access details with anyone. If you need someone to access your information they should register as a user within ManageMyHealth and when the feature is available provide this person access via a managed trust list.
2.5 If in an emergency situation you share your access details to help with your care, we recommend you change your password as soon as practical. If you do share your access details you must ensure that the person you share your access details with also adheres to these Terms of Use.
2.6 If you access someone else’s information, you acknowledge and warrant you have the authority to do so.
2.7 You must advise us and your registering GP practice if you change your email address. All emails sent to your account will be assumed to have been read.
3. Account Closure
3.1 You may close your ManageMyHealth account at any time using the self-service option within your account profile (My Account → Close Account).
3.2 Where a practice terminates its agreement with MMH, we will notify you by email in accordance with the Privacy Policy.
3.3 Where your account has had no activity initiated by you for a continuous period of 12 months and is no longer linked to an active practice on MMH, we will notify you at your registered email address and invite you to log in to resume use of your account within 30 days. If your account remains inactive after that notice period, it will be closed in accordance with our account closure process set out in this section. It is your responsibility to keep your registered email address current.
3.4 Where your healthcare provider stops using ManageMyHealth, we will notify you as soon as practicable and no later than 30 days after the effective date of the practice’s departure. This notification will be sent to the email address registered to your account and will advise you of the change and any steps you may wish to take regarding your account. All health information accessible through ManageMyHealth will be removed and will no longer be available to you.
3.5 Account closure is initiated within 72 hours of submission or confirmation of a closure request. Your personal information and records held on the Manage My Health platform will be permanently deleted within 14 business days of closure initiation. Data held in backup systems will be subject to MMH’s retention obligations as set out in the Privacy Policy.
3.6 A linked account that has not been independently registered and activated will be closed when the primary account is closed.
3.7 Where a linked account has been independently registered and activated, it will not be closed when the primary account is closed. In this case, the link will be removed, and the account will continue independently under these Terms of Use.
3.8 Following account closure, Manage My Health retains certain information in accordance with the retention provisions set out in the Privacy Policy.
4. Privacy
4.1 We consider your use of ManageMyHealth to be private. However, we may access or disclose information about you, your account and/or the content of your communications in order to:
(a) comply with the law or legal proceedings served on it;
(b) enforce and investigate potential violations of these Terms of Use; including use to participate in, or facilitate, activities that infringe the law; or
(c) protect the rights, property, or safety of ManageMyHealth, any ManageMyHealth Party, their employees, customers or the public.
4.3 We may use automated security monitoring, account controls, and other technical measures to protect ManageMyHealth, protect our customers, or prevent violations of these Terms of Use. Any such measures will be taken in accordance with applicable Privacy Law.
4.4 In order to provide you with ManageMyHealth, we may collect certain information about ManageMyHealth’s performance, your device and your use of ManageMyHealth. We may automatically upload this information from your device. This data will not personally identify you.
4.5 In addition to the above, the ManageMyHealth Privacy Statement and Code of Conduct forms part of these Terms of Use. By agreeing to these Terms of Use you also give your consent to the way we may handle your personal information under that statement. You can access the ManageMyHealth Privacy Policy or Code of Conduct by clicking on the links.
4.6 Manage My Health may communicate directly with you in respect to your account, the security of your information, changes to our services, or any matter required by law, in our capacity as a service provider, independent of any healthcare provider. This does not extend to direct marketing communications, which require your separate opt-in consent.
4.7 Health Information accessible through Manage My Health that originates from your healthcare provider’s systems remains controlled by that provider. Manage My Health is unable to amend or delete such information on request. Where you wish to access or correct this information, we will assist you in directing your request to the appropriate healthcare provider contact.
5. Intellectual Property
5.1 All copyright, trademarks, designs, patents and other intellectual property rights (registered and unregistered) in and on ManageMyHealth and all content (including all applications) located on the site shall remain vested in ManageMyHealth or its licensors (which includes other users).
5.2 You may not copy, reproduce, republish, disassemble, decompile, reverse engineer, download, post, broadcast, transmit, make available to the public, or otherwise use ManageMyHealth content in any way except for your own personal, non-commercial use unless otherwise agreed in writing with ManageMyHealth.
5.3 You agree not to adapt, alter or create a derivative work from any ManageMyHealth content except for your own personal, non-commercial use. Any other use of ManageMyHealth content requires the prior written permission of ManageMyHealth.
5.4 Nothing contained in these terms shall be construed as conferring you any license or right to use any trademark, design right or copyright of ManageMyHealth or any other third party.
5.5 You warrant that all content uploaded or shared by you, either from your own computer or another source, are either created or owned by you, or that you have the necessary licenses, rights and permissions to use the content uploaded or shared.
5.6 You acknowledge and agree that upon receipt and notice of any claim from a third party, ManageMyHealth may immediately remove any content from ManageMyHealth without liability. Any claims of any complaining party shall be referred to you for your attention.
6. Content
6.1 You agree in respect of any content uploaded on the Website that it complies with the ManageMyHealth Code of Conduct, and without limiting the Code of Conduct does not:
(a) infringe any intellectual property rights of any third party;
(b) infringe the privacy rights of any third party;
(c) detrimentally affect the brand or reputation of ManageMyHealth or any affiliates or partners of ManageMyHealth;
(d) mislead as to the nature, type, service or benefits of the content;
(e) contain inaccurate, ambiguous, exaggerated, defamatory, untrue, or out of date information;
(f) encourage, counsel, incite or suggest any criminal or unlawful acts;
(g) seek to take advantage of any individual or individual groups by virtue of their circumstances;
(h) contain vulgar and/or suggestive languages or images or innuendo or slang of a sexual, immoral, racial or violent nature; and
(i) promote or provide inflammatory or demeaning opinions of an individual or group.
6.2 ManageMyHealth does not actively monitor uploaded content but reserves the right to remove or edit any content uploaded at its sole discretion and without notice, regardless of whether or not it is, in the opinion of any third party, in breach of these Terms of Use. 6.3 Health information accessible through Manage My Health originates from your healthcare provider’s clinical or administrative systems. This information remains controlled by the relevant healthcare provider.
6.4 Manage My Health acts as a service provider in respect of such information and is not able to amend or delete it on request. Where you wish to access or correct this information, we will notify your healthcare provider of your request and assist you in directing it to the appropriate contact.
7. No Warranties
7.1 ManageMyHealth is provided on an “as-is,” “with all faults” and “as available” basis.
7.2 ManageMyHealth does not guarantee the timeliness, completeness or performance of ManageMyHealth or any of the content. To the extent permitted by law, ManageMyHealth excludes all representations and warranties (whether express or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
7.3 Some content on ManageMyHealth may be created by third party contributors or members of the public. The views expressed are their own and unless specifically stated are not those of ManageMyHealth. ManageMyHealth is not responsible for any content posted by third parties or members of the public on ManageMyHealth or for the availability or content of any third party site that is accessible through ManageMyHealth. Any links to third party websites from ManageMyHealth do not amount to any endorsement of that site by ManageMyHealth and any use of that site by you is at your own risk.
7.4 ManageMyHealth does not warrant that functions available on ManageMyHealth will be uninterrupted or error free, that defects will be corrected, or that ManageMyHealth or the server that makes it available are free of viruses or bugs. You acknowledge that it is your responsibility to implement sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.
8. Limitation of Liability
8.1 You can recover from ManageMyHealth only direct damages up to any amount you pay ManageMyHealth for use of its service. You cannot recover any other damages, including consequential, lost profits, special, indirect, incidental or punitive damages. If the Consumer Guarantees Act 1993 would otherwise apply to your use of ManageMyHealth and you are accessing or otherwise using this website for business purposes (or holding yourself out as accessing or using it for business purposes), you agree that the provisions of that Act will not apply, to the extent contracting out is permitted by that Act.
8.2 This limitation applies to anything related to access services, information services, forum services, content (including code) on third party sites, third party programs or third party conduct, viruses or other disabling features that affect your access to or use of ManageMyHealth, incompatibility between the ManageMyHealth and other services, software and hardware, delays or failures you may have in initiating, conducting or completing any transmissions or transactions in connection with ManageMyHealth in an accurate or timely manner, and claims for breach of these Terms of Use, breach of warranty, guarantee or condition, strict liability, negligence, or other tort.
8.3 It also applies even if this remedy does not fully compensate you for any losses, or fails in its essential purpose or ManageMyHealth knew or should have known about the possibility of the damages.
8.4 MMH shall not be liable for any of the following losses or damage (whether such damage or losses were foreseen, foreseeable, known or otherwise):
(a) loss of data;
(b) loss of revenue or anticipated profits;
(c) loss of business;
(d) loss of opportunity;
(e) loss of goodwill or injury to reputation;
(f) loss arising from third-party criminal activity, such as data breach, cyber-attack, or ransomware attack;
(g) losses suffered by third parties; or
(h) any indirect, consequential, special or exemplary damages arising from the use of ManageMyHealth regardless of the form of action.
9. Health Assistance Activities
9.1 Unless you choose not to receive them, ManageMyHealth will automatically send you articles or content about lifestyle and healthcare you may find useful or interesting. Any content we send you is produced by our trusted third party partners. We will decide what content you might find useful or interesting based on your personal healthcare record and other personal information you provide to us.
9.2 We provide lifestyle and healthcare content in order to support you on your healthcare journey. You should not rely solely on health content provided by ManageMyHealth as your only source of medical or healthcare advice. Please seek the advice of a qualified medical professional before making any changes to your lifestyle in reliance on any content provided by ManageMyHealth. While we use reasonable measures to ensure health content is accurate and reliable, ManageMyHealth will not be responsible to you for any action or inaction you take in reliance on content we send you.
9.3 Unless you choose not to receive them, ManageMyHealth will automatically send you suggestions about steps you might take in relation to your healthcare (for example: prescription refills, routine tests and checks, or vaccinations). These suggestions will be based on your personal healthcare record and other personal information you provide to us.
9.4 We provide these suggestions in order to support you on your healthcare journey. You should not rely solely on suggestions provided by ManageMyHealth as your only reminder for managing your healthcare. While we use reasonable measures to ensure our suggestions are accurate and reliable, they are based on recommendations that would generally be appropriate for a person in circumstances similar to yours and may not be appropriate for your personal circumstances. ManageMyHealth will not be responsible to you for any action or inaction you take in reliance on our healthcare suggestions.
9.5 As part of ManageMyHealth you have access to our Directory, which you can use to access other third party healthcare and service providers, and insurance providers.
9.6 We provide the Directory in order to support you on your healthcare journey. While we use reasonable measures to ensure the Directory contains reputable and trusted service providers, we will not be responsible to you for any action or inaction of a third party service provider. If you seek or receive healthcare from any third party service provider, your relationship is with them directly.
9.7 As part of our Directory, you have access to insurance partners for your life, health, travel and/or other insurance needs. With your consent, we may share with that insurer any information you have provided to ManageMyHealth that may be relevant to your insurance application, to help you complete your application more efficiently. You are responsible for ensuring that your chosen insurer has all information that is relevant to your application.
9.8 As part of ManageMyHealth you have the option to generate a summary of your health records held by ManageMyHealth (for example, your vaccination record, allergies, and any health conditions). Your health summary may be shared with third parties where we have your consent to do so.
10. Linked Accounts for Dependents
10.1 For children under 16 years of age: you may use ManageMyHealth provided that your parent or guardian creates a ManageMyHealth account in your name (after consulting with your GP). Your parent or guardian will have full access to your ManageMyHealth account, and all your health information contained in it. Once you turn 16, you will be fully responsible for your own ManageMyHealth account and for complying with these terms, and your parent / guardian will not be able to access your health information without your express consent.
10.2 For adults dependent on a guardian or representative: with your express consent, your nominated guardian or representative may create (after consulting with your GP) or manage your ManageMyHealth account on your behalf. This nominee will have full access to your ManageMyHealth account, and all your health information contained in it. You may revoke this consent at any time.
10.3 For parents of children under 16 years of age / nominated representatives of dependent adults: you may create, access and/or manage a ManageMyHealth account in the name of your child, or the dependent adult for whom you are responsible, in consultation with their GP. In doing so, you agree to these terms of use and will be responsible for all activities that are performed on the ManageMyHealth account of the child or dependent adult. Once your child turns 16, you are no longer entitled to access their health information without their consent.
11. Indemnity
11.1 You agree to release, indemnify and keep indemnified ManageMyHealth from and against all actions, claims, costs (including legal costs and expenses), losses, proceedings, damages, liabilities, or demands suffered or incurred by ManageMyHealth from any person arising out of or in connection with your failure to comply with these Terms of Use or your use of ManageMyHealth.
12. Limits on Use
12.1 Without limiting any other rights and remedies available to ManageMyHealth, ManageMyHealth may, at its sole discretion, limit your activities on ManageMyHealth or refuse to provide you access to ManageMyHealth or any part of it if you:
(a) breach these Terms of Use;
(b) breach any ManageMyHealth Privacy Policy;
(c) breach any Code of Conduct; or
(d) where ManageMyHealth considers any of your conduct, in its sole discretion, to be inappropriate.
12.2 In such an event, your access will be blocked and your information will be removed. You will be given the opportunity to obtain your information that you have provided. Health information received from your GP practice, other healthcare providers or other third parties can be obtained from the original source, and not through ManageMyHealth.
12.3 ManageMyHealth may change the range of ManageMyHealth services or remove features at any time and for any reason.
13. Dispute Resolution
13.1 You will not commence any court or arbitration proceedings relating to a question, difference or dispute relating to these Terms of Use (“Dispute”) unless you have first complied with this Disputes Resolution section.
13.2 Where any Dispute arises, you (or your representative) and a representative of ManageMyHealth will meet and negotiate in good faith in an attempt to resolve the Dispute amicably by good faith discussion.
13.3 Where the representatives of the parties do not resolve the Dispute within five (5) Business Days (or as agreed) of initiating negotiations, the relevant parties agree to mediate any Dispute in terms of the LEADR New Zealand Incorporated Standard Mediation Agreement. The mediation will be conducted by a mediator and at a fee paid by the parties to the Dispute.
13.4 If the parties fail to settle the Dispute by mediation then either party may initiate arbitration (but not litigation) in accordance with the Arbitration Act 1996 to resolve the Dispute amicably by good faith discussion.
13.5 Nothing in this section will preclude a party from taking immediate steps to seek urgent injunctive or equitable relief before an appropriate court.
14. General
14.1 If any of these Terms of Use are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any country or area in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive and continue to be binding and enforceable.
14.2 These Terms of Use, the Privacy Statement and Code of Conduct supersede any and all prior oral or written communication on the subject matter contained in them.
14.3 Notices under these Terms and Conditions shall be in writing and shall be deemed given when delivered:
(a) Personally – when they are received;
(b) By email – upon confirmation of receipt;
(c) By overnight mail or conventional mail – two business days after sending.
14.4 ManageMyHealth may assign its interest in ManageMyHealth at any time and for the purposes of this agreement references to ManageMyHealth shall include any person or organisation to which it has licensed or assigned its rights and obligations.
14.5 These terms shall be governed by and interpreted in accordance with the laws of New Zealand which shall have exclusive jurisdiction over any disputes.
14.6 ManageMyHealth is specifically designed to be used in New Zealand only. If you choose to use ManageMyHealth outside of New Zealand, you are solely responsible for adherence to the laws of the country from which you are accessing ManageMyHealth.
